These Terms and Conditions (“Terms”) apply to all the websites, sub-domains, and mobile apps (collectively, we’ll call these “Websites”) of TerraGo Real Estate Limited (“TerraGo”).
By visiting or using the Websites, seeing the content, and using any of the services on our Websites, you are informing us that you have read, understand, and agree to follow these Terms completely when it comes to the Websites. If you are not okay with all of these terms, or if you disagree with anything we have said here, then you should not use, and must immediately stop using, the Websites.
"Content" is all the stuff on our Websites, like designs, articles, words, pictures, sounds, videos, reports, documents, information, data and any other work.
"Land Sale Agreement" is the service we at TerraGo Real Estate Limited provide that lets you buy land from us in installments.
"Purchase Price" is the final cost of the plot of land that TerraGo is selling, and that you, as a Registered User, agree to by saying yes to or accepting the Land Sale Agreement.
"Registered User" is a user who has signed up and made an account with TerraGo. Certain features and services are only available to registered users.
"User" is anyone who uses TerraGo.
"You" means you, as a person who uses TerraGo.
Our Websites provide information about our real estate services where you can buy land on equated instalment payment plans. When we say “the Website,” “the Websites”, “app”, “mobile app”, and “www.terragoug.com” we mean all the software, content and features provided within these Websites.
YOUR RESPONSIBILITIES
a. Acceptable Conduct. You must use the Website only for lawful purposes. If you become aware of any violation of these Terms by any User, individual or entity, please notify us immediately through our contact form and provide us with assistance, as requested, to stop or remedy the violation.
c. Non-Compliance. If you do not comply with these Terms, we may suspend your access to the Websites, pursue legal action or take any other steps we consider appropriate.
d. No Liability. You understand that any of the prohibited actions listed here might cause irreversible damage to your computer, device or mobile phone. TerraGo will not be responsible for any special, consequential, incidental, or indirect damages (including, for example, loss of business profits, business interruption, loss of business information, or any other financial loss) arising from misuse of or inability to use the Websites.
When you use our Websites or act for an organization, you agree to these terms, confirming that you have the authority to accept these terms on the organization's behalf. Any references to "you" in these terms include the organization you represent, along with you personally.
a. Access. Our land sale services with instalment payment plan are only available upon registration with a valid National Identity (NID).
b. Registration. To register, you will need to provide certain personal details according to “Know Your Customer” requirements and create a username and PIN for your Account. Your registration can be accepted, rejected, or cancelled by us for any reason. If cancelled, you'll only have access to the public parts of the websites. Registered users can choose to deregister by contacting Customer Support, provided they have no active transactions, agreements, contracts, etc., in progress.
c. Responsibilities. As a Registered User, you will need to:
d. Compatibility. Our Websites operate on most modern devices.
e. Account Deactivation. A registered user’s account will be removed if the user deactivates it or if we suspend it due to non-compliance with our terms, policies or agreements.
f. Third-Party Content. The Websites may contain links to third-party websites. Using such links means you direct us to access and transmit the linked content to you. The availability of third-party content does not imply our endorsement or affiliation with any third-party. Your use of third-party content is at your own risk and is subject to their respective terms, conditions and policies.
g. Open-Source Components. The Websites may include open-source components, and their use is governed by the terms and conditions of the applicable open-source licenses.
h. Instalment Payment Options. As part of our transaction transparency policy, details about installment payment options for each plot of land will be provided on our Websites. Additionally, Registered Users can access their transaction history through their accounts.
i. Penalty Rates for Defaults. As part of our transparency practices, Registered Users are notified of the daily percentage rate (“Penalty”) for all overdue instalment payments (“Default”).
j. Payment Information. If we enter into a Land Sale Agreement with a Registered User, we will consider the payment information provided by the registered user as eligible for us to process payments with. However, transfer of title will only be done to the registered NID, regardless of the source of payment(s) received.
k. Credit Reporting Disclosure. We may inquire about your credit history and standing, and may report any defaults, including missed payments, to credit reporting agencies. Your credit history may be used to assess your standing with us.
a. Warranties. TerraGo makes no assurances or promises about the Websites, which are provided “as is”. We do not guarantee that the Websites will meet your specific needs, that they will be uninterrupted, secure, or error-free., including without limitation, the warranties of title, and non-infringement.
b. Limitation of Liability. By using the Websites, you accept that there are inherent risks involved with connecting and transmitting data on the internet, such as security threats, performance issues, and interruptions. TerraGo will not be held responsible or liable to you for any losses or damages caused by disruptions or failures of the internet or for any interruptions or restrictions on access to the Websites for any reason. This includes, but is not limited to, viruses, security threats, or any technical or operational failures.
UNDER NO CIRCUMSTANCES WILL TERRAGO REAL ESTATE LIMITED BE RESPONSIBLE FOR ANY INDIRECT, UNEXPECTED, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS INCLUDES LOSS OF PROFITS, GOODWILL, WORK STOPPAGE, SECURITY BREACHES, VIRUSES, COMPUTER FAILURE, DATA LOSS, OR ANY OTHER INTANGIBLE LOSSES. THIS APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES, AND WHETHER THEY ARISE IN CONNECTION WITH THESE TERMS, THE WEBSITES, OR YOUR USE OR MISUSE OR INABILITY TO USE THE WEBSITES.
a. Website Maintenance. The parts of our Websites that are visible to the public are provided for free. User-specific features are available upon creating an account and becoming a Registered User. We may suspend or restrict the availability of our Websites for operational reasons.
b. Our Remedies. We reserve the right to suspend, restrict, or terminate your use of the Websites without notice if we believe you have violated any of these Terms.
c. Governing Law. These Terms of use, their subject matter and their formation, are governed by the laws of Uganda. You and us mutually agree that the courts in Kampala have exclusive jurisdiction.
d. Interpretation. The headings in these Terms are only for convenience and are not to be used for interpreting these Terms.
e. Notices. Any notice or communication related to these Terms:
f. Assignment. We may assign our rights and obligations under these Terms at any time without notifying you. You cannot assign these Terms without our prior written consent.
g. Relationship. You agree that no joint venture, partnership, fiduciary, employment or agency relationship exists between us and you as a result of these Terms or use of the Websites.
h. Force Measure. Neither party will be held responsible for not fulfilling its obligations under these Terms due to circumstances beyond its control, such as natural disasters, government actions, health pandemics, war, riots, strikes, and accidents.

j. Updates. TerraGo reserves the right to update, revise, supplement, or modify these Terms and Conditions and to impose new or additional rules, policies, terms, or conditions on your use of the Service at any time.
These changes will take effect immediately and be incorporated into this Agreement. Your continued use of the Websites signifies your acceptance of any and all such changes.
BY USING THE WEBSITES OR INSTALLING THE APP, YOU AGREE TO THESE TERMS AND CONDITIONS, INCLUDING ANY FUTURE UPDATES.
